Terms and Conditions

Please read these terms and conditions carefully before using our services. By engaging Tony's Contractor LLC, you agree to these terms which establish the legal relationship between us.

1. Introduction

Welcome to Tony's Contractor LLC. These Terms and Conditions ("Terms") govern your use of services provided by Tony's Contractor LLC ("Company," "we," "our," or "us"), including roofing, siding, and other contracting services.

By engaging our services, you accept and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We may revise these Terms at any time without notice. Any changes to the Terms will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

2. Service Agreements

All services provided by Tony's Contractor LLC are subject to a written Service Agreement that details the specific scope of work, materials, timeline, and costs. The signed Service Agreement, along with these Terms, constitute the entire agreement between you and Tony's Contractor LLC.

2.1 Scope of Work

The scope of work ("Services") will be specifically defined in the Service Agreement. Any changes to the scope of work must be agreed upon in writing by both parties and may result in price adjustments.

2.2 Changes and Additional Work

If during the project, you request changes or additions to the Services ("Change Orders"), we will provide a written description of the additional work and associated costs. No additional work will commence without your written approval. Change Orders become part of the original Service Agreement.

2.3 Timeline

We will provide an estimated timeline for completion of the Services in the Service Agreement. While we strive to meet all deadlines, certain factors beyond our control (including but not limited to weather conditions, material availability, inspection delays, and unforeseen conditions) may affect the completion timeline. Tony's Contractor LLC is not liable for delays caused by circumstances beyond our reasonable control.

Important: Project timelines are estimates only and may be affected by weather, material availability, and other factors outside our control. A delay in completion does not constitute a breach of contract.

3. Payment Terms

Payment terms for our services are outlined below. Specific payment schedules will be detailed in your Service Agreement.

3.1 Deposit Requirements

A non-refundable deposit, typically 30-50% of the total project cost, is required before work can begin. This deposit secures your place in our schedule and covers initial material orders. The specific deposit amount will be stated in your Service Agreement.

3.2 Payment Schedule

Payment schedules vary by project and are detailed in the Service Agreement. Typically, our payment structure includes:

  • Initial deposit (30-50% of total cost) due upon signing the Service Agreement
  • Progress payments may be required for larger projects based on completion milestones
  • Final payment due upon completion of the Services

3.3 Payment Methods

We accept the following payment methods:

  • Check (made payable to "Tony's Contractor LLC")
  • Credit/debit cards (Visa, MasterCard, American Express, Discover)
  • Electronic bank transfers
  • Cash

A 3% processing fee may be added to credit card transactions.

3.4 Late Payments

Payments not received according to the agreed schedule are considered late. A late fee of 1.5% per month (18% annually) may be charged on all overdue balances. Additionally, work may be suspended until payment is received.

3.5 Collection Costs

In the event that legal action becomes necessary to collect payment, you agree to pay all associated costs, including attorney fees, court costs, and collection agency fees.

4. Warranties

Tony's Contractor LLC stands behind our work and offers the following warranties:

4.1 Workmanship Warranty

We provide a 5-year workmanship warranty on all installation services. This warranty covers defects in installation and workmanship. It does not cover damage resulting from normal wear and tear, improper maintenance, alterations by others, severe weather events, or acts of God.

4.2 Manufacturer Warranties

All materials installed by Tony's Contractor LLC come with the manufacturer's warranty. Warranty periods vary by manufacturer and product. These warranties are separate from our workmanship warranty and are subject to the specific terms and conditions provided by the manufacturer.

4.3 Warranty Claims Process

To make a warranty claim:

  1. Contact us at (862) 576-5264 or [email protected] with a description of the issue
  2. We will schedule an inspection within 14 business days
  3. If the issue is covered under warranty, we will schedule repairs at no cost to you
  4. Manufacturer warranty claims may require additional steps according to the manufacturer's process

4.4 Warranty Limitations

Our warranties are subject to the following limitations:

  • Regular maintenance as recommended is required to maintain warranty coverage
  • Unauthorized repairs or modifications void the warranty
  • Damage from severe weather events beyond normal weather conditions
  • Issues caused by structural movement or defects in the building
  • Damage from foot traffic or impact

Note: To maintain your warranty, annual inspections are recommended. Tony's Contractor LLC offers maintenance service plans to ensure the longevity of your roofing and siding systems.

5. Property Access and Work Conditions

5.1 Property Access

You agree to provide Tony's Contractor LLC and our subcontractors with reasonable access to your property as necessary to complete the Services. This includes:

  • Access to the work area during normal business hours (8:00 AM - 6:00 PM, Monday through Saturday)
  • Access to electrical outlets and water as needed
  • A clear work area with movable items removed from the project zone
  • Space for equipment, material storage, and debris containers as needed

5.2 Site Preparation

Prior to commencement of work, you are responsible for:

  • Removing or securing fragile items that may be affected by vibrations
  • Ensuring children and pets are kept away from the work area
  • Removing vehicles from driveways or garages if needed for equipment access
  • Marking sprinkler heads, septic systems, or other underground facilities

5.3 Work Hours

Standard work hours are 8:00 AM to 6:00 PM, Monday through Saturday. Work will not be performed on Sundays or major holidays unless specifically arranged and agreed upon in advance.

5.4 Clean-Up

We will make reasonable efforts to protect your property during the work process. At the completion of the project, we will:

  • Remove all construction debris from the site
  • Conduct a magnetic sweep of the grounds to collect nails and metal debris
  • Return the property to a clean and orderly condition

Minor dust and disturbance are normal parts of the construction process and should be expected.

6. Permits and Inspections

6.1 Permit Acquisition

Unless otherwise specified in the Service Agreement, Tony's Contractor LLC will obtain all necessary building permits required for the Services. Permit fees are the responsibility of the customer and will be outlined in the Service Agreement.

6.2 Inspections

We will coordinate all required municipal inspections. You agree to provide access to the property for such inspections. If an inspection fails due to circumstances beyond our control, any re-inspection fees will be your responsibility.

6.3 Code Compliance

All work performed by Tony's Contractor LLC will comply with applicable building codes and regulations at the time of installation. If existing conditions are discovered that do not comply with current codes, we will notify you of the issue. Any additional work required to bring non-compliant existing conditions up to code may result in additional charges.

7. Cancellation and Termination

7.1 Customer Cancellation

You may cancel the Service Agreement subject to the following conditions:

  • Within 3 Business Days: You may cancel without penalty within three business days of signing the Service Agreement.
  • Before Materials Are Ordered: Cancellation before materials are ordered will result in forfeiture of 10% of the deposit to cover administrative costs.
  • After Materials Are Ordered: Cancellation after materials are ordered will result in forfeiture of the entire deposit plus any restocking fees or non-returnable material costs.
  • After Work Has Begun: Cancellation after work has begun will result in payment for all completed work, materials delivered, and a 15% fee on the remaining contract value.

7.2 Contractor Termination

Tony's Contractor LLC reserves the right to terminate the Service Agreement if:

  • Payment is not made according to the agreed schedule
  • Site conditions are discovered that make the project unsafe or impractical
  • Customer or third parties interfere with the progress of work
  • Material changes in building codes or regulations make completion impossible

In the event of termination by Tony's Contractor LLC, you will be responsible for payment for all work completed and materials delivered up to the date of termination.

8. Insurance and Liability

8.1 Contractor Insurance

Tony's Contractor LLC maintains comprehensive general liability insurance and workers' compensation insurance as required by law. Certificates of insurance are available upon request.

8.2 Property Insurance

You are responsible for maintaining appropriate homeowner's insurance during the project. We recommend notifying your insurance carrier before work begins.

8.3 Limitation of Liability

Tony's Contractor LLC's liability is limited to the contract price of the Services. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Damage to interior contents due to existing leaks
  • Pre-existing conditions not visible during initial inspection
  • Damage resulting from acts of God or extreme weather events

8.4 Indemnification

You agree to indemnify and hold harmless Tony's Contractor LLC from any claims, damages, losses, and expenses arising from your breach of these Terms or your conduct.

9. Dispute Resolution

9.1 Good Faith Resolution

In the event of a dispute, both parties agree to attempt to resolve the matter in good faith through direct communication before pursuing other remedies.

9.2 Mediation

If direct communication fails to resolve the dispute, both parties agree to participate in mediation with a mutually agreed-upon mediator. The cost of mediation will be shared equally between the parties.

9.3 Arbitration

If mediation is unsuccessful, any dispute arising from or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Union County, New Jersey.

9.4 Governing Law

These Terms and all aspects of the relationship between you and Tony's Contractor LLC shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law provisions.

10. Miscellaneous Provisions

10.1 Assignment

You may not assign your rights or obligations under these Terms without the prior written consent of Tony's Contractor LLC.

10.2 Subcontractors

Tony's Contractor LLC may, at our discretion, hire subcontractors to perform certain aspects of the Services. All subcontractors will be properly licensed and insured. We remain responsible for the work performed by our subcontractors.

10.3 Promotional Rights

Unless you specifically opt out in writing, you grant Tony's Contractor LLC the right to take photographs or videos of the project before, during, and after completion for promotional, educational, and marketing purposes. We will not publish your name or address without your explicit consent.

10.4 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

10.5 Entire Agreement

These Terms, together with the Service Agreement, constitute the entire agreement between you and Tony's Contractor LLC regarding the Services, superseding any prior or contemporaneous agreements, communications, and proposals.
